When you purchase a new construction home, the builder's on-site agent represents the builder — not you. As your licensed buyer's representative, I negotiate on your behalf, guide you through builder decisions, and return a portion of the buyer-agent commission as an estimated closing credit, subject to lender approval.

Understanding the Program
Are homebuyer rebates legal in Texas?

Yes. Homebuyer rebates are permitted in Texas under Texas Real Estate Commission (TREC) rules when properly disclosed and documented. EXL Realty Group is a licensed Texas brokerage and all rebates are disclosed to the parties and the buyer's lender. This is general information, not legal advice — consult a licensed attorney for guidance specific to your situation.

Does this cost me anything?

There is no out-of-pocket cost to the buyer for our representation. Compensation is typically paid by the builder from the buyer-agent commission they already offer to outside agents. Buyer-agent compensation is negotiable and not set by law.

How much could the closing credit be?

It depends on your service level:

  • Limited Service (Most Popular): We retain a flat $1,000 fee. The remaining buyer-agent commission may be returned as an estimated closing credit.
  • Full Service: We retain 1% of the purchase price. The remaining commission may be returned as an estimated closing credit.

On a $400,000 home assuming a 3% buyer-agent commission, the estimated closing credit is typically $7,000–$8,000, subject to lender approval and the actual commission received.

What can the credit be used for?

The estimated closing credit is most commonly applied to:

  • Closing costs
  • Mortgage rate buydown
  • Builder upgrades or lot premiums
  • Appliances or other allowable items

How the credit is structured depends on your lender's loan program and the parties' agreement; some loan programs limit how rebates may be disbursed.

We work with the vast majority of Texas builders including D.R. Horton, Lennar, KB Home, Perry Homes, Highland Homes, Bloomfield Homes, Toll Brothers, Meritage, and hundreds more. We serve buyers statewide — Dallas-Fort Worth, Houston, Austin, San Antonio, and everywhere in between. Contact us before your first visit and we'll confirm eligibility for your specific builder.

Who qualifies for the rebate?

First-time buyers, repeat buyers, investors, and second-home buyers may all qualify. The program applies to primary residences, investment properties, and second homes depending on builder policies. If you're purchasing a new construction home in Texas, you likely qualify.

The Process
Why do I need to register before visiting a builder?

Most Texas builders require a buyer's agent of record to be registered before the buyer's first visit or communication. If you visit a builder without an outside agent registered first, the builder's on-site representative typically becomes the agent of record, which generally means an outside-agent rebate is no longer available on that transaction. We recommend registering us before your first builder visit.

Can I still qualify if I already visited a builder?

Possibly. Some builders allow late registration while others do not. Contact us immediately — the sooner you reach out, the better your chances.

Do I need to sign a Buyer Representation Agreement?

Yes. A Buyer Representation Agreement (BRA) is required to formally document your rebate eligibility and protect you throughout the transaction.

What is the difference between Limited Service and Full Service?
Full Service — 1% Fee

We provide complete buyer representation — attending meetings (in DFW only), reviewing contracts, negotiating upgrades, closing costs, and lot premiums. We keep 1% and you receive the rest. Best for buyers who want expert guidance at every step.

Can you help negotiate with builders?

Yes — with Full Service. We negotiate upgrades, closing cost contributions, lot premiums, incentives, and contract terms on your behalf. With Limited Service, you handle builder negotiations directly while we manage all the paperwork.

Financing & Payment
Does the rebate affect my mortgage or builder incentives?

Your lender must be informed of the rebate — lenders are required to account for buyer credits and some loan programs have restrictions. We'll work with your lender to structure it properly. Using our program typically does not affect builder pricing or incentives, and in most cases you can use your preferred lender unless a builder incentive requires their in-house lender.

How and when is the rebate paid?

The rebate is paid at or shortly after closing — either as a closing credit or via check/wire transfer. For new construction, closing typically occurs 6–12 months after signing your contract when the build is complete.

Is the rebate taxable?

According to IRS guidance, rebates are generally not considered taxable income. Please consult your tax advisor for advice specific to your situation.
