Questions that apply regardless of which Texas city you're buying in.
Yes. Texas does not prohibit real estate agents from sharing their commission with buyers. Under TREC rules, licensed brokers may return a portion of their earned commission to a buyer as a closing credit. Our program is operated under EXL Realty Group (TREC Broker License #9015220). Buyer-agent compensation is negotiable and not set by law or any MLS rule. Read the full breakdown, straight from TREC's own guidance →
Limited Service (flat $1,000 fee, available statewide): the builder-paid commission, minus our $1,000 fee, may be returned to you as an estimated closing credit subject to lender approval. No in-person representation is included. This is the most common service level for buyers outside of DFW.
Full Service (1% fee, available in Dallas–Fort Worth only): includes full in-person buyer representation. Jakir attends all builder meetings, reviews purchase agreements and all addenda, and negotiates upgrades, lot premiums, closing cost contributions, and rate buydowns on your behalf. The estimated closing credit is typically the 3% commission minus 1%, returned at closing subject to lender approval.
Subject to lender approval, the estimated closing credit can be applied to: closing costs, a mortgage rate buydown, builder upgrades (structural or design center selections), or lot premiums. Each lender has its own limits on how closing credits may be used: discuss your options with your lender early in the process. We work closely with your lender to structure the credit in the most beneficial way for your situation.
Builder sales contracts typically define "procuring cause": the party who first introduced the buyer to the property. If you visit a model home without a registered buyer agent, the builder's on-site sales representative becomes your de-facto agent, and most builders will not honor an outside agent's representation retroactively. Registration takes 2 minutes and is free. It simply establishes Jakir Malek (EXL Realty Group) as your agent of record before that first visit.
